Once the company claiming arbitration has sent to GAFTA a statement setting out the details of the claim, together with supporting evidence (the submissions), a timetable will be prepared. The other party to the dispute is able to submit their response to the claim. It is important that all documents or statements are seen by both parties and that they have every opportunity to reply to them. Once this process is complete the arbitrators will publish their decision in an award of arbitration. GAFTA's aim is for the arbitration award to be published where possible within 6 months of the receipt of the first submissions.

Yes. GAFTA provides a two tier arbitration facility. Once the first tier award is published the parties have 30 days from its date to lodge an appeal with GAFTA. When it is received, GAFTA will appoint a five man board of appeal to hear the appeal against the first tier award of arbitration. They will hear both parties' arguments and when completed will produce an appeal award. This award is final and binding on the parties.

Any dispute arising out of a contract or arbitration agreement, which incorporates or refers to these Rules, shall be referred to arbitration, and arbitrator(s) or board of appeal, as the case may be, will proceed to determine all issues put before them, in accordance with these provisions.

Where the Parties agree that the arbitration shall be held in accordance with the GAFTA Simple Dispute Arbitration Rules Form No: 126, they shall send to GAFTA the signed Arbitration Agreement in accordance with these rules.

Upon receipt by GAFTA of the parties’ written agreement to refer their dispute and/or differences to mediation, the Association shall appoint a GAFTA Qualified Mediator in accordance with these rules.
