Agribility - The Hague and Hague Visby Rules

In this module we will consider how and when the Rules are incorporated into the contract of carriage, and some of their key terms. In particular, the shipowners’ duty to exercise due diligence before and at the beginning of the voyage to make the ship seaworthy, the shipowners’ defences to claims for loss of, or damage to, goods including negligence in the navigation or the management of the ship, and the time limit for the Bill of Lading holder to bring legal proceedings against the shipowner.
By the end of this module, the learner should be able to:
- Explain why the Hague and Hague Visby Rules came into force.
- Determine the obligations and rights imposed under the Rules.
- Discuss the relevant articles and understand any time limits within the Rules.
- Identify any potential defences under the Rules.
