EU-US Boeing Airbus dispute– EU continues the suspension on duties
Following on from previous Gafta circulars in 2020/361, 2021/120, recalling the longstanding WTO aircraft dispute between EU and US (Boeing -Airbus), please note today the EU has published Regulation 1549/2026 extending the suspension of EU duties on US aircraft and non-aircraft products which included eg wheat, meslin and beet pulp pellets (see EU regulation 1646/2020 for full list).
On 9 March 2021, the EU and the US reached an understanding to mutually suspend all measures for a period of four months. On 8 July 2021, following a further understanding reached between the EU and the United States agreement was reached to mutually suspend all measures for a period of five years, applicable until 10 July 2026.
The update today is that the US has not reimposed retaliatory measures, and in view of the absence of any substantive change in the factual and legal circumstances underlying the WTO disputes on large civil aircraft, the Eu has also agreed to continue the suspension of duties given the conditions that justified the suspension of the Union’s measures persist. Regulation 1549/2026 published today ensures the continued suspension on the EU side, but the suspension will be kept under review. Regulation 1549/2026 enters into force on 11th July 2026.
