ADR
Alternative Dispute Resolution (ADR) refers to methods of resolving disputes without going to court. Gafta provides both arbitration and mediation services for resolving disputes. This module will focus on these two main forms of ADR in relation to disputes under Gafta contracts.
By the end of this module, the learner should be able to:
- Discuss the advantages of ADR as opposed to litigation.
- Identify and describe the different types of ADR and identify which Gafta Rules apply.
- Understand the arbitration process under the Arbitration Rules No.125 and the Expedited Arbitration Procedure Rules No. 126 and discuss the key differences between them.
- Understand where ADR fits into the English Court Structure.
