The Inter-Club Agreement (ICA) apportions cargo liability between shipowners and charterers. This module is designed to provide an understanding of why the maritime industry sought a mechanism to swiftly apportion liability for cargo claims. The module will also provide a detailed explanation of how the ICA works.
By the end of this module, the learner should be able to:
- Discuss how liability is apportioned under the ICA
- Explain how the ICA is incorporated into the charterparty and discus the conditions that must be satisfied in order for the ICA to apply to a claim
- Provide an example scenario of a claim under the ICA and explain what the apportionment of liabilities would be
- Confidently discuss the advantages and disadvantages of the ICA
- Know the time limits that apply to ICA claims
